Can I Get Benefits Off Of My Ex-Husband's Earnings?
I am on Social Security Disability got approved before my divorce and they never mentioned anything about going off my spouses amount he worked more as I stayed home and worked taking care of our children. Can I go and get it off his earnings?
Hi,
If your ex is still living, the earliest that you could qualify for divorced spousal benefits is at age 62. Even then, you could only qualify if your ex is either drawing his benefits or is at least age 62 and his full retirement age rate (PIA, or primary insurance amount) is more than twice as much as your . . . Will SSA Really Suspend My Survivor Benefits When I Reach Age 62?
I will be 60 in a few months and have applied for my divorced deceased ex spouse benefit with SSA. The representative said that I fall under new regs implemented a few years ago and that I will be notified a few months prior to my 62nd birthday requesting that I apply for my own social security benefit. If I don't then my divorced deceased ex spouse benefit will be suspended. I asked for the POM Manual regs. on this but was given the SSA publication "What Every Woman Should Know"...to page 17 that only states that at age 60 you can receive this benefit if you aren't entitled to . . . Why Can't My Husband Answer Question 26 On The Social Security Application Form?
My husband is 66 and 8 months old and will apply for benefits when he's 67. On page 72 of your book you say to make absolutely sure to put in writing when you wish benefits to begin in the remarks section. (He will apply online) On the application he cannot answer item 26 because he is six months over FRA. Why is that? One of the questions (c) is when to begin benefits. He does not want retroactive benefits, and wants all of his delayed retirement credits.
Hi,
It sounds like you might be referring to the paper application form SSA-1. That form is . . . Read More

Can An Ex-Spouse Start Taking Their Own Benefits At Age 65 And Switch To Divorced Spousal Benefits Later?
Is there a problem for an ex-spouse to start taking her own SS benefit at age 65 and wait till her ex-spouse starts drawing his SS benefit 6 years later when he turns 65 and switch to half of his benefit? They were married long enough (27 years).
Hi,
You can't switch from drawing benefits on your own record to drawing other types of benefits, such as spousal or divorced spousal benefits. However, in the scenario you describe it would be possible for someone to start drawing their own retirement benefits now and then qualify for additional benefits on . . . Read More

What Will Happen If My Husband Earns More Than The Earnings Limit?
My husband filed for retirement benefits March 2018. He will turn 66 FRA November 2018.
I am confused about the first year earnings limit rule.
If he earns less than $45360 for the year Jan-Dec 2018 but some months March - October he might go over the $3780 per month as he is in sales. Will Social Security go by what benefits the recipient the most or do they only allow you to earn $3780 a month. If he happens to go over the $45360 but that amount wasn't reached until November or even December does he have to prove he didn't earn the $45360 in the months prior to . . . Read More

Will I Be Able To Get At Least Some Of My Social Security?
My husband is 65 and I am 55, we are both working full-time. He is planning on applying for his social security when he turns 66 but will continue to work. I work for the Texas Ed Agency and have 19 years of service and I also have 10 years of service working outside of TEA. I keep hearing that maybe yes, maybe no I will be able to get some of my social security. I also heard that it may be better to resign from TEA instead of retiring and rolling over my TEA to my Roth and that way I can get both. It's very confusing and I want to maximize my benefits.

Can I Switch From SSDI To Widow's Benefits And Not Have A Limit On My Earnings?
I'm 56 on SSDI. My spouse passed away this year at 70. There's only a few dollars difference in our benefits. My question is if I take my spouses benefits as a widow can I earn money from working without a cap or limit?
Hi,
I'm sorry for your loss.
What it sounds like you may be eligible for are disabled widow's benefits (DWB), which have the same basic work and earning limitations as do Social Security disability (SSDI) benefits on a person's own record. For more information regarding those limits, refer to the following Social Security . . . Read More

Can I And/Or My Husband FIle Restricted Applications For Spousal Benefits If Neither Of Us Has Filed For Our Own Benefits?
Unclear on restricted application, I will be 66 October 2018, husband will be 66 March 2018, both plan to start collecting SS at age 70. QUESTION: when I turn 66 in October can I file restricted application collecting a spousal benefit even though both of us are delaying SS to age 70? Can he do the same when he turns 66? I have read numerous articles and SSA info on this topic and I am still confused.
Hi,
No. The only way that you could qualify for spousal benefits is if your spouse is drawing retirement or disability benefits on their own record. . . . Read More
