Are There Legal Rules Regarding My Situation?

I've been fighting w SS for Divorced Spousal Benefits for 50 months and recently won at an ALJ hearing. The Operations Manager Div1 of SSA sent it to the Appeals Council and they are intent on overturning that decision and deny me DSBs and is now the 30 days in which I had to respond to. I did by fax asking for more time and telling them I intend to further plea my case. Oh how I wish I had read your info before. I applied for DSBs and was told by a Tech Expert to do this I had to File and Suspend.

If I Win Some Lottery Money Could I Keep My SSI Retirement?

Just have one question. If I won some Lottery money could I keep my SSI retirement , I retired at 62.

Lottery proceeds would have no effect on Social Security benefits. However, if you're receiving Supplemental Security Income (SSI) then lottery proceeds could affect your eligibility or benefit rate. SSI is a needs based benefit administered by Social Security, so any changes in a recipient's income or resources can have an impact on those payments.

Can I Find Out If My Ex-Wife Is Drawing Social Security From My Employment Record?

Is there any way that I can find out if my ex-wife is drawing social security from my employment record without asking her directly? She is entitled to it that's not the issue.... can I ask Social Security for this information since it is my employment record?

Isn't Not Allowing Disabled Claimants To File For Early Retirement Benefits At Age 62 Discrimination?

I have been told by numerous SSA trained sources, that disability benefits automatically convert to retirement benefits at full retirement age. And when I ask say, "Non disabled claimants are advised to elect early retirement at age 62, when their higher earning spouse files for early retirement benefits -- thus permanently reducing their retirement benefit".

Was My Brother Misinformed?

My question is about filing a restricted application. My 67 year old brother (5/1/1952), currently employed, went to the social security office to file for spousal benefits on his wife's record. She is 72, retired, and has been collecting since reaching FRA. He was told that he was not eligible for spousal benefits because he earns more than $70,000 per year. I have not read anything about an income cap for spouses. Is this new or was someone misinformed? If they were misinformed, is there a specific rule to which he could point?

Can I Collect Unemployment?

My job (rif) is going away the end of June. I am 74 years old collect social security as well as my income in order to continue to pay for my house and bills. Can I collect unemployment? I do have a PERS 2 retirement plan and currently collect $1424 each month. I've been working since I was 18 took about 6 years to have kids and then went back to work part time when they went to school. I am divorced and live along(except for my cat) and I'm worried about my small savings and retirement if my social security is reduced. Can I collect unemployment? Thanks for your response.

How Would Moving To Malaysia Affect My Wife's Social Security?

I'm a natural born citizen, married for 25 years. My wife, who is a legal permanent resident of the U.S. for 25 years, recently retired from her job. She held that job for 20 years. She has made a good salary, earning over 6 figures for 10 of those years. She has, of course, paid into Social Security the entire time. We now plan to move abroad (Malaysia) for our retirement. We were wondering how that could affect her Social Security? I have read conflicting information and heard conflicting anecdotes.

Is There No Recourse I Can Take?

Hello.
They still haven't released my wife's final underpayment. It has now been 6 months.
Call after call it's just one more excuse/reason/delay.
I now believe I will grow old (I already am) without ever receiving the payment.
This morning it was just more him-hawing as usual.
They said they'd forward the manager to manager note to their manager...and that will take 2 weeks or more.
This is insane.
You mentioned that you assumed I had a higher monthly payment than my wife.
Actually, no.
