Ask Larry

Will This Be Good Enough For Approval Of The Judge?

Morning
Have a hearing in May for SS disability, have herniated discs, stenosis . Own a business , was dragging myself to work to remain open, but over last few mo this , I’m only going in to close at night, about 10hours weekly. Will this be good enough for approval ofjudge? And not making any money there , so no salary, income.
Thank you

Hi,

Your work probably won't disqualify you from qualifying for disability benefits as long as you aren't earning more than an average of $1180 per month or performing services in your business that Social Security or the Administrative Law Judge (ALJ) handling your case feels is reasonably valued at more than that (https://secure.ssa.gov/apps10/poms.nsf/lnx/0410510010).

Otherwise, I would have no any way of knowing whether or not your medical impairment will be judged severe enough to meet Social Security's disability guidelines. That will be up to the ALJ to decide based on your medical records.

Best, Jerry
