Why Did Social Security Deny My Mother's Claim For Disabled Widow's Benefits?

My mother has been getting disability since 1991 and her late husband passed away that she had been married to for 11 years and he was receiving social security and she filed for disable widows pension and was denied because the examiner said she didn’t coaparate well and she had to appeal it just want to know why and that’s not fare at all

Hi,

I don't know enough details about your mother's case to be able to answer your question. If your mother applied for benefits and if her claim was disallowed, regardless of the reason, her only recourse would be to file an appeal. It sounds like she's done that, so the only thing I can suggest is for her to complete any forms requested by Social Security. Depending on the circumstances, Social Security may need to obtain medical records to verify that your mother is disabled, and they'd need her permission to obtain those records.

By the way, only widows who are between the ages of 50 & 60 can qualify for disabled widow's benefits, although widow's who are at least 60 or older can potentially qualify for widow's benefits without being disabled. The full eligibility requirements for widow's and disabled widow's benefits can be found here: https://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0401.html.

Best, Jerry
