I have received a notice from the appeals council that I am disabled as of oct 11 2021 I received the latter may 26 2022 I am approved for widows benefits on my husbands insured social security . I also applied for ssi he said he remanded the administrative law judge to decide if i could get the months prior to October 2021 seeing as i filed from June 2020. I’m just wondering for the decision appeals council found partially favorable to me saying I’m disabled as of oct 11 2021 when ill get my payments . Thank u

Hi. I can't give you a proper answer without knowing all of the details of your case. What I can tell you is that there is no waiting period for Supplemental Security Income (SSI) disability payments, so if 10/11/2021 is established as your disability onset date then you could potentially get SSI back pay roughly retroactive to that date. There is a 5 full calendar month waiting period for Social Security disabled widow's benefits (DWB), though. So, with an onset date of 10/11/2021, your waiting period would be November 2021 through March 2022 and your first month of DWB eligibility would be April 2022.

As for when you'll actually start receiving payments, that would depend on Social Security's processing times. And, if your case has been remanded to the hearings level, there could be a delay while the administrative law judge's office makes their revised determination.
