What Happens If A Person On SSDI Earns $1100 Monthly For An Extended Period Of Time?

In terms of the SSDI trial work period earnings limitation, provision regarding earnings above $880/month and “substantial” earnings as $1220/month. What happens between those two limits? I.e earnings are $1100/month for an extended period of time? Also, what happens if Sean uses all of his “Trial Work Months” and exceeds the $1220 income limitation for a period of time – would he have to reapply and recertify as disabled to begin receiving benefits again?

A person receiving Social Security disability (SSDI) benefits who works and earns $1100 monthly for an extended period of time would use up their 9-month trial work period (TWP) but they would not lose any of their benefits. SSDI recipients only lose their benefits due to work if they earn more than the substantial gainful activity (SGA) level after completing their TWP.

If a person on SSDI does earn more than the SGA level and their benefits are terminated, then yes a new application and new disability determination would be required in order to again qualify for SSDI. However, SSDI benefits aren't actually terminated for at least the first 3 years after a person completes their TWP. That period of time is referred to as an extended period of eligibility (EPE). During the EPE a person's benefits are suspended if they're earning above SGA level, but their benefits can be reinstated without a new application if they stop work or if their earnings drop below SGA level before the EPE ends. By the way, the above rules also apply to people who receive Social Security disabled widow's and disabled adult child's benefits.
