Social Security Overpayments

Can I Still Get My Back Pay?

i won my waiver to dismiss my over payment can i still get my backpay of 8300 im broke and struggling to pay my bills

Hi,

I'd need to have much more information about your case to be able to give you an answer. When an overpayment is waived, it doesn't mean that you weren't actually overpaid. In other words, in most cases when Social Security waives an overpayment, they've decided to allow you to keep benefits that were incorrectly paid to you.

Is It Legal For Social Security To Take My Brother-In-Law's Disability Benefits To Repay The Unemployment He Qualified For?

Hi,
I helped my brother in law, who is self employed part time with a residential cleaning business, obtain unemployment in TN when the pandemic started. All his jobs asked him to not clean their homes until the pandemic was over. He was approved for and received the $600 per week plus TN Unemployment.

How Do I Resolve This?

In 2016 I received SS payments but paid no taxes and I made more than I was allowed to according to the IRS SS rules so was set up on a payment plan @ $100/moth. It is now 2020 and I am 67 as of February and they are still taking $100/month to pay back the SS money. At the same time, they stopped paying me my SS money since 2016 - March 2020 to pay back the SS I received in 2016. This looks to me like double or more payback to the IRS. They say there is still a balance due. I think they OWE ME money. I do I resolve this?

How Do I Handle This Situation?

I applied for divorced spouse benefits in early 2015 when I was 68 after receiving notification that I could be entitled to this benefit. I told Social Security I did not want this benefit if it affected my account in any way. I was subsequently approved for this benefit and received a lump sum payment in late 2015. I submitted a request to end this benefit and start receiving retirement benefits from my own account effective June 2016 when I was 69. During the time I was receiving divorced spouse benefits Social Security suspended my retirement account.

Why Is Social Security Making Me Pay So Much Back Each Month?

I turned 66 feb 3, 2020. I am drawing half of my husbands social security. My question is 1994 I was drawing s.s.disability from back surgery and injury. I later was able to work some part time. I went to get work release each time. I went back to work full time 6 yrs ago. When I went in feb. to start drawing they said they over paid me in disability,ty benefits $21,000.00 so I had to pay back over half of my monthly check and repay. I will only get $300 each month for 3 yrs until -aid. Instead of $1028 a month.

If I'm Repaying A Social Security Overpayment Can SSA Take My Tax Refund?

I have a overpayment im paying for with ssa if im makin payments every month can ssa take my tax refund

Hi,

No, Social Security won't offset your tax refund to recover an overpayment if you have an approved repayment plan and you are making the agreed upon payments on timely basis.

Best, Jerry
