I was released from prison Nov 2020 and my disability from SS was suspended. I applied for and got pandemic unemployment in Dec 2020 then last week in March I got reinstated on unemployment. the rules say you have to report and SSDI when you apply for unemployment and at that time I had 0. So my question is since the rules say nothing about reporting after you filed and I did not apply for SSDI since I got unemployment it was just reinstated. I am able and available to return to work so am I safe collecting both and I see nothing in TEXAS workforce commission rules that I have to report it after Ive applied for unemployment. And how does unemployment even know if I am now getting disability?
Hi. My expertise is limited to Social Security benefits, so I can't tell you what you're required to do if you collect unemployment benefits. I assume that would depend on the laws governing the unemployment insurance. I'm not sure how the agency handling your unemployment found out about your disability benefits, but I assume you must have authorized them to obtain that information when you applied for the benefits.
It sounds like your Social Security disability benefits have now been reinstated, but if you do return to work you're required to report your work and the amount of your earnings to Social Security.
