Hi,

I'm sorry, but I'm not a lawyer so I can't give legal advice. My expertise is limited to Social Security benefits. You couldn't receive either Social Security spousal or survivor benefits based on your boyfriend's earnings history unless you've been legally married to him. The definition of a legal marriage varies by state, but if your relationship isn't recognized as a legal marriage then you wouldn't qualify for benefits from your boyfriend's Social Security record. Even if you were married, though, you'd need to meet the other requirements (https://www.ssa.gov/OP_Home/handbook/handbook.03/handbook-0305.html) in order to collect spousal benefits.

Best, Jerry
