Ask Larry

Is It Correct That My Benefit Rate Is Reduced Due To WEP?

Hi Larry,

Re: WEP

I am receiving US Social Security payments. The WEP is 50% because I receive Canadian Social Security and I worked for a local government here in Canada for over 20 years. Is this correct? I don't believe I should be penalized WEP because I worked for a Canadian local government. I never worked for the government in the US. Would appreciate clarification on this. Can I appeal this if they made a mistake. I have been receiving benefits for 3 months now.

Thank you very much

Hi,

It's probably correct although I would need much more information to be able to tell you for sure. From what you've described, though, it doesn't sound like you'd meet any of the exceptions to WEP (https://www.ssa.gov/pubs/EN-05-10045.pdf).

You can file an appeal but there is normally a 60-day time limit for requesting an appeal unless you have good cause for late filing (https://www.ssa.gov/pubs/EN-05-10041.pdf).

Best, Jerry
