Ask Larry

Can You Give A More Definitive Answer?

I am essentially in the same position as the person who asked about the WEP and how it might not impact clergy... That link is here... https://maximizemysocialsecurity.com/am-i-excepted-windfall-elimination-...
Can you give more details or a more definitive answer to this question? Thanks!

Hi,

I'm not really sure what you're looking for. The Windfall Elimination Provision (WEP) has a number of exceptions as noted in the reference from Social Security's operations manual that I linked to my previous answer (https://secure.ssa.gov/apps10/poms.nsf/lnx/0300605362), but whether or not any of those exceptions apply to you depends on your specific set of circumstances.

Section B.2 of the above reference cites P.L. 98-21, so if you'd like to read the details of that provision you can find it using the following link: https://www.ssa.gov/OP_Home/comp2/F098-021.html. Or, for a more plain language general explanation of WEP, it may be helpful for you to read the following Social Security publication: https://www.ssa.gov/pubs/EN-05-10045.pdf.

Best, Jerry
