Can Or Should I Draw From My Deceased Husband's SS Now?

My husband just recently died at age 58, I am 63 and I still work full-time. Can I or should I draw from on his SS benefits as his widow?

Hi. I'm sorry for your loss. Whether or not you could collect benefits depends on how much you're earning. Social Security would need to withhold $1 of your benefits for each $2 that you earn in excess of $18,960 this year, so if you earn too much you may not be able to draw any benefits.

Regardless of how much you earn, though, you would likely at least qualify for a one-time death benefit of $255. If you haven't already applied for that benefit, you'll probably want to call Social Security to apply.

It sounds like your best strategy for claiming benefits would likely be one of the following:
1) File for reduced widow's benefits now or as soon as your earnings will permit at least some benefits to be paid, then switch to your own record at age 70; or,
2) File for reduced retirement benefits on your own record now or as soon as your earnings will permit at least some benefits to be paid, then file for unreduced widow's benefits at full retirement age (FRA).

Normally, you would want to start out drawing the lower benefit first and then switch to the higher benefit when it reaches it's highest potential rate.
