Can My Children Get Back Pay On My Record?

I have custody of 2 kids who gets disability. I was just fully approved for mines after 2yrd and 6months are the elgaber to get back pay from my social security disability

Hi,

The answer to your question depends on the type of disability benefits you qualify for, and your benefit rate. If you are entitled to Social Security disability benefits based on your own work record (SSDI), then your children who are under age 18 or who became disabled prior to age 22 could qualify for auxiliary benefits on your record. And, their entitlement could be retroactive as far back as your month of SSDI entitlement assuming that you listed them on your original application for benefits.

However, there is a special family maximum formula used for determining the family benefit rates on SSDI records (https://www.ssa.gov/OACT/COLA/dibfamilymax.html). This formula could result in your children being eligible for a benefit rate anywhere in the range from zero up to as much as 50% of your benefit rate.

Bottom line, you'll need to check with Social Security to see if your children can qualify for benefits on your record.

Best, Jerry
