Can I Apply For Only Spousal Benefits When My Husband Files?

My husband, born 6/52, will wait until age 70 to file for SS benefits. I was born 11/53. When he files at age 70, will I be able to file for restricted application at age 68 1/2, allowing me to wait until age 70 to file under my own work history? My benefits at age 70 will be more than half of his at his FRA.

Hi,

Yes, you can. If you had been born after January 1 1954, however, the answer would be no. The difference is due to changes in the deeming rules passed by Congress in 2015 (https://secure.ssa.gov/apps10/reference.nsf/links/02052016024404PM). Fortunately for you, you were grandfathered under the new law.

Best, Jerry
