Can I Appeal When My Medicare Premiums Increase?

Our 2020 taxes will be higher by $180,000 due to withdrawals of 401 k. Can I appeal in 2022 when Irmaa in increased. 2021 income will be way below threshold

Hi. Yes, you can file an appeal or ask Social Security to make a new initial determination based on a more recent tax return on which to base your Medicare premiums, but that would only change your IRMAA status if the change in your income resulted from what's defined as a life-changing event (LCE). If you think you'd qualify, you can find the required form here: https://www.ssa.gov/forms/ssa-44-ext.pdf.

Best, Jerry
