Ask Larry

Am I Going To Jail For Lying To Social Security?

I lied to ask about being married to my husband am I going to jail because I was his payee and I don't want it any more so he told them he want to take care of his own money.so they ask if he was married and he say yes and I said no

Hi,

If you were simply acting as representative payee for your husband, as long as you used his benefits properly I doubt if you'll have a problem with Social Security. Proper use of benefits is using them to pay for the beneficiary's needs like food, clothing and housing, and saving any remainder for their future needs.

People who are prosecuted for Social Security crimes are mostly limited to those who fraudulently receive benefits for themselves, such as lying on an application in order to receive spousal benefits.

Best, Jerry
