Am I Eligible To Receive Spousal Benefits On My Deceased Ex's Record?

I married my current husband at 60+ years of age and am currently 80 years old. My ex husband of 38 years died July 2016. Am I eligible to receive spousal benefits?

Hi,

Yes, it sounds like you would qualify for surviving divorced spousal benefits as long as your ex-husband's benefit rate was higher than your own rate. Your current marriage wouldn't bar you from potentially qualifying for survivor benefits on a prior spouse's record as long as your remarriage occurred at age 60 or later (https://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0406.html). You should probably check with Social Security as soon as possible in order to find out if you are eligible for additional benefits.

Best, Jerry
