Am I Eligible For Benefits From My Divorced Spouse?

Hello Larry, I was married for 23 years, divorced, received nothing from my husband and I continued to raise my children on my own till they moved from home. I continued to work till 58. Moved in with my daughter because she wanted me to live with her and husband in Japan.

Hi. I assume you want to know if you can receive benefits on your ex-spouse's record. To be eligible, your ex-spouse must either be deceased, at least age 62, or drawing Social Security disability or retirement benefits. You must also be at least age 62 and unmarried to potentially qualify for benefits if your ex is still living (https://www.ssa.gov/OP_Home/handbook/handbook.03/handbook-0311.html).

If your ex is deceased, you could potentially qualify for survivor benefits as early as age 60, or earlier if you're disabled. But, you'd either need to be unmarried, or if married, your current marriage occurred after you reached age 60 (https://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0403.html).

Also, if you're already drawing your own benefits, you could only be paid additional benefits from your ex's record if your divorced spousal or survivor rate is higher than your own benefit rate.
