Would My Ex-Spouse Be Subject To An Earnings Limit?

My ex-spouse was born before 1954 and is FRA. I am 63. If he files for the divorced spouse 50% benefit is he subject to an earnings limit as I would be if I were to claim for myself? Many thanks

No. Your ex's earnings wouldn't be limited by the earnings test if he is at least full retirement age (FRA). And, if you filed for your benefits prior to FRA and had earnings in excess of the earnings test exempt amount, that would not affect the payment of divorced spousal benefits on your record provided that the divorce occurred prior to your month of entitlement to benefits.
