If I Started Drawing From My Husband's Social Security At Age 62, Can I Collect Half Of His Amount Now That I'm 78?

I started collecting from my husbands social security at 62 I am 78 and he is 89 can I collect 1/2 now

Hi. No. The percentage reduction that's applied to your benefit rate if you collect benefits prior to your full retirement age (FRA) is permanent. The reduction for age doesn't go away when you reach FRA or any subsequent age.

However, if your husband dies before you, your survivor benefit rate will not be reduced for age regardless of the fact that you started collecting spousal benefits at age 62. In the event of his death, you could be paid . . . Read More

Will There Ever Be A Point That My Disabled Son Will Be Subject To Less Extensive CDRs?

Hi Larry, my son is a disabled adult child getting ready to start claiming SSDI from his dad’s record next month. My question is will there ever be a point where he will receive the short form CDR every 3 years, or will he always get the long form with the full CDR every 3 years. He’s 25 now and not due for another review for 2 more years. Thank you so much.

Hi. There isn't a specific age at which your son would no longer be subject to continuing disability reviews (CDR), since having a disabling condition is a requirement for eligibility to disabled adult . . . Read More

Can You Help Us Get Our Stimulus Payments?

Didn’t get my stimulus check don’t know what happened, please help us with this situation

Hi. I'm sorry, but I'm unable to help you with that. My expertise is limited to Social Security benefits, and stimulus payments have nothing to do with Social Security. You'll likely need to address your questions to the IRS (https://www.irs.gov/coronavirus/economic-impact-payments).

Best, Jerry

Is There Anything I Can Do?

I was working part time and I was on ssdi. I stayed below the SGA monthly amount. My part time job was a debt collector. My employer had been giving collectors weekly prizes for contests of how many collection payments per hour were obtained. For example if a collector got at least 2.5 payments per hour then they would receive a prize (initially were gifts or gift cards). If the collector got less than 2.5 payments per hour then they would receive no prize. Later in the year my employer had changed the prize method to cash incentive pay. So instead of a gift or gift card the . . . Read More

If I Marry When I Turn Age 60 Can I Collect My Widow's Benefits?

If I MARRY WHEN I TURN 60 CAN I COLLECT MY WIDOWS BENEFITS

Hi. Yes, at least potentially. A remarriage at age 60 or later doesn't not prevent a person from qualifying for survivor benefits on the record of a former deceased spouse (https://www.ssa.gov/OP_Home/handbook/handbook.04/handbook-0406.html), however, you must meet the other requirements for benefits. The requirements for widow(er) benefits are outlined in the following section of Social Security's handbook: . . . Read More

If My Wife Files For Her Own Benefits Prior To FRA Will Her Survivor Rate Also Be Reduced?

I am 73 and began collecting social security at 69. My wife is 63 and considering collecting her benefit now at the reduced amount.
She talked to the social security administration on the phone and asked them if I died after she had reached her full retirement age (66 years and 7 months) could she collect my full benefit amount. They said that since she had started taking her benefits early at the reduced rate, that if she converted to my benefits after I passed they would be paid at a reduced rate.
I thought that since she would be converting to my benefits after . . . Read More

Is It True That You Can Only File A Survivor Claim Up To Thirty Days In Advance?

Hi Larry If you file a survivor claim with social security the system only lets them activate it within 30 days. Not 3 months Is that true. Once a survivor claim is filed can it be cancelled Do you ever have to pay back the money.

Hi. No. You can apply for survivor benefits up to 4 months prior to the month you want to start drawing your benefits. Social Security's processing times vary depending on the circumstances involved, but that doesn't limit the time period that you're allowed to apply for benefits.

You can't "cancel" a claim for survivor . . . Read More

Will Social Security Deem My Wife To Be Filing For Spousal Benefits If She Files For Her Own Benefits At Age 67?

My wife and I are the same age. And I understand the deeming rules (that if a person files for either their retirement or spousal benefit, they are also deemed to be filing for the other benefit too). My question is, I thought that my wife could file for her retirement benefit at FRA (which is 67 for both of us). But I would delay filing for my retirement benefit until age 70, at which time she would file for her spousal benefit. But will SS deem that she filed for her spousal benefit at 67 even though I didn't file for my retirement benefit? If so, how does SS calculate what . . . Read More

Would My Own SS Amount Be Reduced If I Collect A TRS Survivor Pension?

My spouse has a decent TRS pension.
I understand her SS punishment by WEP & the significant loss of any spousal SS I can give her.

I’m entitled to half of the TRS pension amount should she pass.
My question is; would my own SS amount start being reduced if I ever started collecting that survivor TRS pension?
Thank you,

Hi. No. Only pensions that are based on a person's OWN earnings that were exempt from Social Security taxes count for purposes of the Windfall Elimination Provision (WEP). Drawing a pension that's based on a . . . Read More

Can I File For Spousal Benefits Now And Wait Until Age 70 To File For My Own Benefits?

Is it possible to let me know if I can file for spousal benefits and then claim my higher benefit? I am married, birthday 10/06/53 and wife was 9/12/60. I have much higher SS beneftis than wife. She just filed on July 2022 since she turns 62 and will receive her first ss check in Nov 2022. I plan to file for spousal benefits this month and let my benefit grow until 2023, when I am 70. Then, 3 months before I am 70, I will file for my own benefit.
1. Is this strategy possible?
2. Does is matter if I when I file for the spousal, ie, is it OK to file for this while my . . . Read More
