You can check out your legal options with a lawyer if you want, but there is an established appeals process for questioning a Social Security determination with which you disagree. You can find the instructions for filing an appeal on the following Social Security website: https://www.ssa.gov/apply/appeal-decision-we-made.

The last step of the appeals process is filing a federal district court action, which in essence would amount to suing Social Security.
